I'm pretty sure they can, but there's no restriction on them being set up 9" away from the enemy, so I wanted to check I wasn't missing something.

yes, Turn 1 assaults and assaults from DS arrival is possible unless stated other wise. Specifically the Night Scythe and Monolyths are transports. So as long as the unit is with in 3 inches on arrive and more than 1 inch away from enemy, you can move, and charge as normally.

Where does it say it's got be 9" away? The Entry in my book for both Night Scythe and Monolith treats it like disembarking from a transport -So at least 1" away from the enemy, and within 3" of the "transport"

This rule does not appear in the core rules anywhere I can tell. Pretty sure the 9" bubble is strictly reinforced by the Datasheet rules. If your datasheet doesn't have a 9" bubble rule, no such rule exists for that unit.

EDIT: after looking at the entries in question in the Index, volatilegaz has the right of it. It's just like they disembarked--charge away.
